A Chester County woman, a consumer, struck back at a national junk debt buyer, Midland Funding LLC, when its debt collection law firm, Mann Bracken, LLP, allegedly violated her debt collection rights. The woman filed a lawsuit under the Fair Debt Collection Practices Act (FDCPA), when Midland Funding's agent threatened her and harassed her over the telephone. She filed her lawsuit in the Eastern District of Pennsylvania seeking a judgment against Midland Funding for an unspecified amount of money representing her statutory damages, actual damages, attorney’s fees, and costs.
The Philadelphia woman alleged that Midland Funding is responsible for the unlawful treatment she allegedly underwent when Mann Bracken tried to collect a debt she disputed. Because Mann Bracken was acting on behalf of Midland Funding, she alleges Midland Funding must be held accountable. "According to the Complaint, Midland Funding's agent did not provide proper validation or verification of the alleged debt," said her attorney, Joseph A. Mullaney, III. Citing the Complaint, Mullaney also said, "While my client patiently waited for some evidence of the disputed debt, Midland Funding allowed my client to be harassed."
The consumer wants to send a clear message to Midland Funding that when a junk debt buyer wants to collect a disputed debt, it had better follow the law and verify the debt with some evidence that it is actually owed.
