The Sindaco Law Firm Threatens to Unlawfully Garnish Wages Pennsylvania Woman Alleges

The Law Office of Dimitrios Kolovos, LLC filed a Complaint on behalf of a Pennsylvania woman against The Sindaco Law Firm in the federal court for the Middle District of Pennsylvania. She seeks damages, attorney's fees, and costs of the litigation for the Defendants' alleged violation of the Fair Debt Collection Practices Act (FDCPA).
The FDCPA, a federal law that regulates the activities of debt collectors, is a very powerful statute that protects consumers from debt collection that is harassing, oppressive, or abusive. The Complaint alleges, among other things, that The Sindaco Law Firm mailed two dunning letters to the consumer threatening to garnish her wages as a result of her not paying an alleged consumer debt.

According to her attorney, Joseph A. Mullaney, III, "Pennsylvania does not generally permit the garnishment of a consumer's wages to pay an alleged debt." When a law firm like The Sindaco Law Firm threatens to garnish a consumer's wages, "it is doubly wrong since attorney debt collectors should know that Pennsylvania law will not generally permit wage garnishment and the FDCPA prohibits false debt collection threats," Mullaney said. While it may be possible to garnish Pennsylvania wages for child support, student loans, and back taxes, "a Pennsylvania consumer should immediately contact a consumer rights attorney if a debt collector like The Sindaco Law Firm threatens to garnish his or her wages or makes any other threats," Mullaney also said.
